Circana, Inc or a subsidiary or affiliate (“Circana”) is providing you access to its software, software as a service, or services (collectively, the “services”) subject to the terms of an executed Master Services Agreement or License Agreement between you or your company (the “Agreement”). The Agreement governs the use of the Services. By downloading, installing, or using the services, you acknowledge and agree that you are familiar with, understand, and agree to be bound by the terms of the Agreement.
Except as expressly provided otherwise in the Agreement, you will not (i) modify, copy or create any derivative works based on the services; (ii) license, sublicense, sell, resell, rent, lease transfer, assign, distribute, or otherwise make the Services available to any third party, other than to affliates or authorized parties as permitted by the Agreement; (iii) reverse engineer or decompile any portion of the Services, including but not limitted, any software procured and utilised by Circana in the provision of the Services, except to the extent required by law; (iv) access the Services in order to build any commercially available product services that infringes or misappropriates Circana’s intellectual property rights in or to the Services; (v) knowingly send or store infringing, obscene, threatening, or otherwise unlawful or tortious material, including material that violates privacy rights, using the Services; (vi) knowingly send or store malicious code in connection with the Services; or (vii) maliciously interfere with or disrupt performance of the Services or the data contained therein.
The Circana Global Commercial Privacy Policy and Notice describes how Circana collects and uses information about you. By using the Services you are agreeing to the privacy policy.
